The Convention of 2009 on Compensation for Damage Caused by Aircraft to Third Parties also known as the General Risks Convention of 2009 has become a document that considerably broadened the responsibility for damage caused by foreign aircrafts. The scope of the Convention extends to damage to third parties which occurs in the territory of a State Party caused by an aircraft in flight on an international flight (Art. 2), the Convention provides for types of damage to be compensated (Art. 3) and the responsibility regimes. In accordance with the Convention the only person responsible for damage caused is the operator. Actions for compensation under the provisions of the Convention may be brought only before the courts of the State Party in whose territory the damage occurred (Art. 16). Despite having been signed by dozens of states up to date the Convention has not yet entered into force icpdf.
