At the beginning of October 2013 Protocol No 16 to the European Convention on Human Rights and Fundamental Freedoms was opened for signature by Member States of the Council of Europe. The Protocol which introduces the possibility for the highest national courts to ask the European Court for an advisory opinion is a product of the incessant reform process of the Court. The Protocol to the ECHR aims to strengthen the national implementation of the Convention by increasing interaction between the European Court of Human Rights and domestic courts. To enter into force the Protocol requires only ten ratifications by States Parties to the European Convention on Human Rights, so it is an opt-in addition to the Convention, applying only to those state parties willing to ratify this Protocol.
