We regularly assist aviation clients and financiers with all forms of debt financing and securitizations, including secured financings of aircraft, engines and spare parts. We draft and perform appropriate mortgage agreements if aircraft is already registered in the Ukrainian Civil Aircraft Registry. We receive AEP codes at the Ukrainian State Aviation Service to register bill of sales, security agreements and leases at the Cape Town International Registry.

Compulsory Aircraft Repossessions and Airline Bankruptcies

Ganna Tsirat frequently represents both creditors and lessors in workouts, restructurings and voluntary and compulsory repossessions of aircraft in Ukraine. Within the last 10 years, she repossessed at least 10 aircraft including those from Aerosvit, Donbassaero, and AirOnix. All these aircraft repossessions have been made without Cape Town instruments.

She has extensive experience counseling and representing foreign clients with respect to airline bankruptcies in Ukraine, including those of Aerosvit and Donbassaero.

Ganna Tsirat has issued monography on Unification of Norms in International Private Air Law in Ukrainian in 2018 as well as a lot of articles in Ukrainian and foreign journals on Cape Town Convention regulation and its implementation in Ukraine, on operators’ liability, on peculiarities of transactions with aviation equipment.

Ganna Tsirat is a permanent speaker at international conferences where she reports on aviation liability and insurance, unification in international private air law.
